If we do this, we will post the changes to these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. The most current version of these Terms of Use supersede all prior versions.  Your continued use of the Service or the Site after any such changes constitutes your acceptance of the new Terms of Use.  If you do not agree to abide by these or any future Terms of Use, please do not use or access (or continue to use or access) the Service or the Site.

Setting up your Account

When you register with the Site and set up your ForwardMyAddress.com account, you must provide accurate and complete information, such as your name, e-mail address, physical address and any other personal or preference information that you provide to us. Only one account may be created per e-mail address. You agree to promptly update your ForwardMyAddress.com account information with any new information that may affect the operation of your ForwardMyAddress.com account or provision of the Service.  You authorize TPP, directly or through third parties, to make any inquiries we consider necessary or appropriate to verify your ForwardMyAddress.com account information.  Our Privacy Policy, contains information about our policies and procedures regarding the collection, use and disclosure of information we receive from ForwardMyAddress.com Users. You agree not to use false identities or impersonate any other person or use a username or password that you are not authorized to use.  TPP reserves the right to require you to change your ForwardMyAddress.com username for any reason and may do so at any time, or to shut down any account TPP deems in its sole discretion to be unauthorized.

Safeguarding Your Account

You agree that you are responsible for safeguarding and maintaining the confidentiality of your username, password and corresponding ForwardMyAddress.com account information.  You agree not to disclose your password to anyone.  You agree that you are entirely and solely responsible for any and all activities or actions that occur under your ForwardMyAddress.com account, whether or not you have authorized such activities or actions. You agree to immediately notify TPP administrators of any unauthorized use of your username, password or ForwardMyAddress.com account.

User Conduct

You understand that the Service and the Site are available for your personal, non-commercial use only.  You hereby agree not to use the Service or the Site to:

• harvest or collect e-mail addresses or other contact information of other users from the Service or the Site by electronic or other means for the purposes of sending unsolicited e- mails or other unsolicited communications;
• use the Service or the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site;
• use automated scripts to collect information from or otherwise interact with the Service or the Site;
• upload, transmit or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
• register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;
• impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity through fraud or other form of social engineering;
• upload, transmit or otherwise make publicly available on the Site any private information of any third party, including, addresses, phone numbers, e-mail addresses, Social Security numbers and credit card numbers;
• upload, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
• upload, transmit or otherwise make available content that would constitute, a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
• use or attempt to use another's account, service or system without authorization from TPP or from that account’s registered user, or create a false identity on the Service or the Site.
• grant access to any password-protected content, account, or areas of ForwardMyAddress.com to another unauthorized person.
• upload, post, transmit or otherwise make available content that, in the sole judgment of TPP, is objectionable or which restricts or inhibits any other person from using or enjoying the Site, or which may expose TPP or its users to any harm or liability of any type.
• hack TPP’s system or network.

Authorization

By using the Service, you hereby authorize TPP to act as your authorized agent to sign instruments necessary process your change of address order, and otherwise instruct, as applicable, third parties to process your official change of address orders for USPS® and other third parties designated by you.

Change of Address Orders

USPS® Change of Address Orders must be completed by the person, executor, guardian, authorized officer, or agent of the person or business for whom mail would be forwarded by the USPS® mail forwarding change of address order. You hereby expressly authorize TPP to act as your agent for completing, executing and processing any and all change of address forms and orders requested by you through the Service. You herby represent that you understand that submitting false or inaccurate information on the form through the Site is subject to punishment by fine or imprisonment or both under 18 U.S.C. §§ 2, 1001, 1702 and 1708. All other address change notifications made by someone other than the person for whom the address change is requested requires such person’s express consent.

Intellectual Property Rights in Site Content; Limited License

All content on the Site and available through the Service, including designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (the “Site Content”), are the sole property of TPP, its affiliates or third parties with all rights reserved. The Site Content is protected by copyright, trade dress, trade secret, unfair competition, and other laws and may not be copied or imitated in whole or in part. All custom graphics, icons, and other items that appear on the Site are trademarks, service marks or trade dress ("Marks") of TPP, its affiliates or other entities that have granted TPP the right and license to use such Marks and may not be used or interfered with in any manner without the express written consent of TPP. Except as otherwise expressly authorized by these Terms of Use, you may not copy, reproduce, modify, lease, loan, sell, create derivative works from, upload, transmit, or distribute the Site Content in any way without TPP’s or the appropriate third party's prior written consent. Except as expressly provided herein, TPP does not grant to you any express or implied rights to TPP’s or any third party's intellectual property or proprietary information.

Provided that you meet the eligibility requirements to use the Site and become a registered User, you are granted a limited, nontransferable, nonsublicensable, revocable license to access and use only the Site, the Site Content and the Service only in the manner presented by TPP for your personal, non-commercial use. You are prohibited from uploading or republishing Site Content on any Internet, Intranet or Extranet site or incorporating the information in any other document, database or compilation. Such limited license is subject to these Terms of Use and does not permit use of any data mining, robots, scraping or similar data gathering or extraction methods. Any use of the Site or the Site Content other than as specifically authorized herein, is strictly prohibited and may terminate the license granted herein. Such unauthorized use may also violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable by TPP at any time without notice and with or without cause.

Third Party Websites and Content

The Site contains (or you may be sent through the Site or the Service) links to other web sites ("Third Party Sites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software and other content or items belonging to or originating from third parties (the "Third Party Applications, Software or Content"). Such Third Party Sites and Third Party Applications, Software or Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by TPP, and we are not responsible for any Third Party Sites accessed through the Site or any Third Party Applications, Software or Content posted on, available through or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the Third Party Sites or the Third Party Applications, Software or Content. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, TPP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, AND FITNESS FOR A PARTICULAR PURPOSE. Governing Law and Jurisdiction

To the fullest extent permitted by law, this agreement, disclaimers, terms, and conditions, shall be governed by, construed, and enforced in accordance with the internal substantive laws of the State of Texas, as it is applied to agreements entered into and to be performed entirely within such State, without giving effect to any principles of conflicts of laws. ANY ACTION OR PROCEEDING YOU, ANY THIRD PARTY, OR TPP BRING TO ENFORCE THIS AGREEMENT OR OTHERWISWE BROUGHT IN CONNECTION WITH ANY MATTERS RELATED TO THIS SITE OR SERVICE, SHALL BE BROUGHT ONLY AND EXCLUSIVELY IN EITHER THE STATE OR FEDERAL COURTS LOCATED IN DALLAS COUNTY, TEXAS, AND YOU EXPRESSLY WAIVE ANY OBJECTION THAT YOU MAY HAVE NOW OR HEREAFTER TO SUCH VENUE OR TO THE JURISDICTION OF SAID COURTS AND EXPRESSLY CONSENT TO THE EXCLUSIVE VENUE AND JURISDICTION OF SAID COURTS. Miscellaneous

You may not assign these Terms of Use or any of Your interests, rights or obligations under these Terms of Use. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions contained herein. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing by TPP. TPP reserves the right, in our sole and absolute discretion, to change, modify, add, or remove portions of our sites and these disclaimers, terms, and conditions at any time.
